Litigation and Conflict Resolution Practice
As a general practice, we undertake impartial case evaluation. Predicated on our evaluation we act as resource persons to give confidential opinion on the strengths and weaknesses of our client’s claim(s). We proceed to represent our clients in arbitration and other forms of conflict resolution, or litigation.
The case evaluation enables our clients to not only maintain important business relations by amicably settling disputes amenable to such settlement, but to also save costs by pursuing litigation in cases where they have strong, sustainable claims that are not amenable to amicable out-of-court settlement.
We appreciate that at times it may prove imperative to pursue court litigation, either to assert or defend ones rights in strong claims, or pursuant to firmly held principles. At CKR Advocates we handle a wide variety of civil disputes, relating to:
- Corporate and commercial disputes
- Prosecuting and defending intellectual property infringement cases
- Banking and financial claims
- Bankruptcy, insolvency
- Judicial winding-up proceedings
- Employment and labour disputes
- Contractual disputes and claim
- Construction and building claims
- Professional negligence and malpractice claims
- General civil, contract and commercial litigation.
As a general rule, we do not handle criminal briefs. However, in exceptional cases, we may undertake criminal defence cases for our corporate clients, particularly in criminal prosecution for alleged criminal offences against the body corporate and its directors.
During my lifetime I have dedicated myself to the struggle of the African people. I have fought against white domination, and I have fought against black domination. I have cherished the ideal of a democratic and free society in which all persons live together in harmony and with equal opportunities. . . . . It is an ideal which I hope to live for and to achieve. But if needs be it is an ideal for which I am prepared to die.Nelson Mandela’s statement from the dock in The State v. Nelson Mandela & others Joel Joffe, The State v.
